These terms of use (the "Terms") set out the terms and conditions upon which we, myGaru Tech Limited with our registered address at C/O Fieldfisher Riverbank House, 2 Swan Lane, London, United Kingdom, EC4R 3TT and with company number 11963760 ("we", "us" or "our"), make available our website (the "Website"), any features and content published on the Website or other material otherwise made available to you on our Website (the "Content"), to any and all individuals who directly or indirectly access the Website and its Content (each a "User", "you" or "your").

By using our Website and the Content made available to you as a general visitor to our website, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use or browse our Website or access our Content.

These Terms do not cover your use of any products or services that may be provided to you by myGaru which will be subject to a separate agreement.

You are responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

1. Your access to the Website

Our Website is available free of charge for the purposes of reading about our service and reviewing a demonstration version of how our service works.

We do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons.

2. Security

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. We may amend these Terms from time to time. Every time you wish to use our site, or sign into your account, please check these terms to ensure you understand the terms that apply at that time.

We may also update and change our site from time to time to reflect changes to our products, our users' needs and our business priorities.

In consideration of you agreeing to comply with these Terms, we grant you a non-transferable, non-exclusive licence (i.e. permission) to use the Website subject to these Terms. We reserve all other rights which are not granted or provided for in these Terms.

You must not use the Website: (a) in any unlawful manner, for any unlawful purpose, or to act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into Website or any operating system used by the Website, (b) in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users, (c) to collect or harvest any information or data from the Website or our systems or attempt to decipher any transmissions to or from the servers running the Website, (d) to send, knowingly receive, upload, download, use or re-use any material which does not comply with these Terms, or (e) to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

Relying on our Website

The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

We will only use your personal information in relation to the Website as set out in our Privacy Policy. Should you choose to use our services and download the myGaru App you will be provided with a separate Privacy Notice for use of that App.

8. Rules about linking to our site

You may link to the home page of the Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our Website in any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

We reserve the right to withdraw linking permission without notice.

We are the owner or the licensee of all intellectual property rights on our Website and in the material published on it. These works are protected by intellectual property laws and treaties around the world. All such rights are reserved.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

Our trade marks are registered

myGaru is a UK registered trade mark of myGaru Tech Limited. You are not permitted to use it without our approval.

10. Termination

We may terminate these Terms and/or your permission to use the Website immediately if: (a) you commit any breach of these Terms, (b) we discontinue the Website, or (c) we are prevented from providing the Website for any reason.

Furthermore, we reserve the right to change, edit, suspend, delete and/or cancel any part of the Website and/or your access to it at any time with or without notice to you: (a) if required by law, or (b) due to an event beyond our reasonable control.

On termination of these Terms for any reason: (a) all rights granted to you under these Terms will immediately cease and (b) you must immediately cease all use of the Website.

11. General and Governing Law

These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
